Logic and Brazilian Constitution

Shared in accordance to the criteria established by article 5, he provisions of Clause I, II and II, of the Brazilian Constitution, of October 4, 1988 (Fundamental Rights and Guarantees): “All persons are equal before the law, without any distinction whatsoever, Brazilians and foreigners residing in the country being ensured of inviolability of the right to life, to liberty, to equality, to security and to property, on the following terms:

 

“Men and women have equal rights and duties under the terms of this Constitution”;

 

“No one shall undergo legal proceeding or sentencing save by the competent authority”

 

and “habeas corpus and habeas data proceedings and, under the terms of the law, the acts necessary to the exercise of citizenship are free of charge”.

 

Just one of the terms is in the Universal Declaration of Human Rights, one of the terms is in the Brazilian Criminal Code and other is in the Brazilian Civil Code, independently of the order, Only one of the statements is true in accordance to the logic:

 

- ‘Men and women have equal rights and duties under the terms of this Constitution” is in the Universal Declaration of Human Rights.

- “No one shall undergo legal proceeding or sentencing save by the competent authority” isn’t in the Universal Declaration of Human Rights.

- “Habeas corpus and habeas data proceedings and, under the terms of the law, the acts necessary to the exercise of citizenship are free of charge” isn’t in the Brazilian Civil code.

 

 

Therefore,

 

a)      ‘Men and women have equal rights and duties under the terms of this Constitution” is in the Brazilian Civil Code “No one shall undergo legal proceeding or sentencing save by the competent authority” is in the Brazilian Criminal Code “habeas corpus and habeas data proceedings and, under the terms of the law, the acts necessary to the exercise of citizenship are free of charge” is in the Universal Declaration of Human Rights.

b)      ‘Men and women have equal rights and duties under the terms of this Constitution” is in the Brazilian Civil Code “No one shall undergo legal proceeding or sentencing save by the competent authority” is in the Universal Declaration of Human Rights “habeas corpus and habeas data proceedings and, under the terms of the law, the acts necessary to the exercise of citizenship are free of charge” is in the Brazilian Criminal Code.

c)      ‘Men and women have equal rights and duties under the terms of this Constitution” is in the Brazilian Criminal Code “; No one shall undergo legal proceeding or sentencing save by the competent authority” is in the Brazilian Civil Code “habeas corpus and habeas data proceedings and, under the terms of the law, the acts necessary to the exercise of citizenship are free of charge” is in the Universal Declaration of Human Rights.

d)      ‘Men and women have equal rights and duties under the terms of this Constitution” is in the Brazilian Criminal Code; “No one shall undergo legal proceeding or sentencing save by the competent authority” is in the Universal Declaration of Human Rights “habeas corpus and habeas data proceedings and, under the terms of the law, the acts necessary to the exercise of citizenship are free of charge” is in the Brazilian Civil Code.
